Why as no burger company used this for their mobile nav?

Because it's an designers inside joke and the users will find it tacky.

In this form, yes. But maybe there's another way of approaching it that's less tacky and still clever? Take a look at the Star Wars menu icon - http://i.imgur.com/4ao7Ig6.png - little lightsabers that still make a menu icon.

Slightly off topic but I liked this approach used by McDonalds in an email campaign. Two burgers created from table cells when images weren't shown...

Haven't got an example to post, but Pizza Express do a really good job of the same thing.
An email they used to send out had someone preparing a pizza in a kitchen and the cells behind it created a cartoon style version of him.

That's just a icon. It's not a true hamburger icon in appearance or functionality. Therefore, no, not like that.

I can't for the life of me remember who, but one of the big designers (like Jason Santa Maria or Jonathan Tan or someone) did actually make their mobile nav a hamburger as an in joke... Anyone remember who it was?
They sure try, this franchise was the first. Icon of an actual hamburger next to a H2 that says “Desserts”.
Makes sense. (They serve mostly greasy food, usually represented by burgers. And ice cream. And cookies. And shakes. So… various kinds of hamburgers.)
On a usable burger site, it could’ve been a nice touch.
